GameMonk Terms of Service

1. Acceptance of Terms

By accessing or using GameMonk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and GameMonk.

2. Description of Service

GameMonk is a Slack bot application that provides interactive games and entertainment features. The Service is provided for entertainment purposes only. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

GameMonk does not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The Service will meet your requirements or expectations
  • Any defects or errors in the Service will be corrected
  • The Service is free of viruses or other harmful components

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMEMONK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of third parties on or through the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

IN NO EVENT SHALL GAMEMONK'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO GAMEMONK IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

5. Assumption of Risk

You acknowledge and agree that your use of the Service is at your sole risk. You are solely responsible for any damage to your computer system, mobile device, or loss of data that results from your use of the Service. You assume all risks associated with your use of the Service, including but not limited to risks of damage to your devices, loss of data, or interruption of service.

6. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate any right of a third party, including by infringing or misappropriating any third party intellectual property right
  • Post, upload, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by GameMonk and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

8. Third-Party Services

The Service integrates with third-party services, including but not limited to Slack. Your use of such third-party services is subject to their respective terms of service and privacy policies. GameMonk is not responsible for the availability, accuracy, or reliability of any third-party services.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Indemnification

You agree to defend, indemnify, and hold harmless GameMonk and its officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your breach of these Terms or your access to, use, or misuse of the Service.

12. Disclaimers

GameMonk makes no representations or warranties regarding:

  • The accuracy, completeness, or reliability of any content provided through the Service
  • The availability, uptime, or performance of the Service
  • The compatibility of the Service with your devices, software, or network configurations
  • The security of data transmitted through the Service

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GameMonk operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and GameMonk regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.
